1. Your right to use the Campavolt service may be terminated or suspended by us at any time, without warning, for any reason including non-compliance with these terms, or any relevant law or regulation.
2. We reserve the right to modify or discontinue our service at any time without notice. We are not liable for any loss, damage, or inconvenience caused by your inability to use our service due to downtime or discontinuance.
3. These terms are governed by UK law. Both parties agree to submit to the jurisdiction of the Greater Manchester courts.
4. Disputes will be handled informally at first, followed by binding arbitration in Oldham, UK, under the rules of the European Court of Arbitration. Exceptions apply for certain intellectual property, privacy, and injunctive relief claims.
5. We maintain certain data that you transmit to the service, for managing its performance. You are responsible for all data you transmit or that relates to your use of the service. We are not liable for any loss or corruption of this data.
6. Our liability to you for any cause is limited to £50. We, our directors, employees, or agents will not be liable for any indirect or consequential damages arising from your use of the service.
7. You agree to defend and indemnify us against any claims or demands made by a third party due to or arising out of your use of the service, your breach of these terms, any breach of your representations and warranties set in these terms, your violation of third-party rights, or any harmful act towards another user of the service.
8. You consent to receive communications from us electronically, agree to the use of electronic signatures, contracts, orders, and other records, and electronic delivery of notices and records of transactions initiated or completed by us. You waive any rights or requirements under any laws requiring an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.
9. These terms constitute the entire agreement between you and us, and supersede all prior understandings. Our failure to enforce any right or provision of these terms shall not operate as a waiver. These terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations at any time. We are not liable for any failure to act caused by causes beyond our control. If any provision of these terms is deemed unlawful, void, or unenforceable, that provision is severable from these terms and does not affect the validity of the remaining provisions. No joint venture, partnership, employment, or agency relationship is created between you and us as a result of these terms. These terms will not be construed against us by virtue of having drafted them. You waive any defences you may have based on the electronic form of these terms and the lack of signing by the parties to execute these terms.
10. If you are not completely satisfied with your purchase, you can return the product to us within two weeks of the delivery date. All returned items must be in good condition and in their original packaging. Once we have received and inspected the returned item(s), we will notify you of the status of your refund. If your return is approved, we will initiate a refund to your original method of payment. Please note that the time it takes for the credit to appear on your account may vary, depending on your card issuer's policies. You will be responsible for all shipping costs for returning your item. Shipping costs are non-refundable. Please contact us if you have any questions on how to return your item to us.
11 The life expectancy of the product under normal use conditions is approximately 10 years. At the end of this period, additional data can be added to the device at a cost of £10 for another 10-year period. However, as cellular technology is continually evolving, we may implement a buy-back scheme at that time. This scheme would allow users to return their old device, which we would replace with a new one featuring the latest cellular technology. Please note that the conditions and details of any such scheme will be determined at the time of its implementation and will be communicated to users.
